1. Scope

1.1 These Terms of Service (the "Terms") govern access to and use of the Website by any visitor. By using the Website, you accept these Terms.

1.2 Orders placed on the Website are governed by our [General Terms and Conditions of Sale]. For anything relating to an order, they prevail over these Terms.

1.3 Sales to retailers and other professional customers are governed by separate conditions communicated with each quotation.

2. Access to the Website

2.1 The Website is accessible free of charge to anyone with internet access. Connection costs and equipment are at your expense.

2.2 We may suspend, restrict or modify all or part of the Website at any time, in particular for maintenance, updates or security reasons. We do not guarantee uninterrupted availability.

3. Customer account

3.1 Creating a customer account is optional. If you create one, you undertake to provide accurate information and to keep your login credentials confidential. You are responsible for activity under your account and must inform us promptly of any unauthorised use.

3.2 We may suspend or close an account in the event of a serious breach of these Terms or fraudulent use, after notifying you by email unless urgency or the law prevents it. Suspension does not affect orders already concluded.

4. Acceptable use

You agree not to:

  • use the Website for unlawful or fraudulent purposes, including placing orders with a payment method you are not authorised to use;
  • extract, copy or index the Website's content by automated means (bots, scrapers) without our written consent;
  • interfere with the operation or security of the Website, or introduce viruses or harmful code;
  • impersonate any person or provide false information.

5. Product information and use

5.1 We describe our products with care. Photographs are indicative: colours may appear differently depending on your screen, and slight variations in shade or surface finish are inherent to moulded silicone. Details are set out in the General Terms and Conditions of Sale.

5.2 WhereWolf? products are holders designed for the Apple AirTag, which is sold separately. They do not themselves locate or track an animal. Location depends on the AirTag and Apple's Find My network, over which we have no control.

5.3 Our products are not toys. Follow the warnings on the packaging, check the product regularly for wear, and remove it if damaged.

6. Intellectual property

6.1 The texts, photographs, illustrations, designs, logos and the WhereWolf? name appearing on the Website are protected by intellectual property rights and belong to Helflex International SRL or are used with the permission of their rights holders.

6.2 You may view and print Website content for your personal, non-commercial use. Any other reproduction, adaptation or distribution requires our prior written consent, except where the law provides otherwise.

7. Reviews and user content

7.1 When you publish a review, photograph or comment on the Website, or authorise us to reuse content you have posted on social media, you confirm that you hold the necessary rights and grant Helflex International SRL a free, non-exclusive licence to reproduce and display that content on the Website and our social media channels, worldwide and for as long as the content remains published. We will credit you where possible and remove the content on request within a reasonable time.

7.2 Content must not be unlawful, offensive or misleading, or infringe third-party rights. We may refuse or remove content that breaches this Article.

7.3 : Reviews are not checked against purchases. We do not remove reviews because they are negative.

The Website may contain links to third-party websites (for example payment providers, carriers or social networks). We do not control them and are not responsible for their content or practices.

9. Liability

9.1 We take reasonable care to keep the Website accurate and secure, but cannot guarantee that it is free of errors, interruptions or harmful components.

9.2 To the extent permitted by law, we are not liable for indirect damage arising from the use of, or inability to use, the Website, or from third-party websites.

9.3 Nothing in these Terms limits our liability for death or personal injury caused by our fault, for fraud, intentional misconduct or gross negligence, nor your statutory rights as a consumer, including the legal guarantee of conformity and product liability.

10. Personal data and cookies

Personal data is processed in accordance with our Privacy Policy. Cookies other than those strictly necessary for the Website are placed only with your consent, which you can withdraw at any time via cookie settings.

11. Changes

We may amend these Terms. The applicable version is the one published on the Website, with its date of update. Each order remains governed by the General Terms and Conditions of Sale accepted at the time of ordering.

12. Language

These Terms are available in English, French and Dutch. All three versions have equal value.

13. Governing law and disputes

13.1 These Terms are governed by Belgian law. If you are a consumer residing in another EU Member State, you keep the protection of the mandatory provisions of the law of your country of residence.

13.2 Please contact us first at [contact@wherewolf.pet] so we can look for a solution. Consumers may also turn to the Consumer Mediation Service (see Legal Notice).

13.3 Failing an amicable solution, disputes with professional customers are submitted to the courts of Brussels. Consumers may bring proceedings before the courts designated by law.
